Notarizing isn’t complicated — but doing it wrong is expensive.


In Florida, small mistakes can create big liability issues. The good news? If you follow a clean system every time, you stay protected and your notarizations stay solid.


Here’s the exact 5-step framework:


1ļøāƒ£ Require Personal Appearance


Before anything else — the signer must physically appear in front of you.

This is not optional.


Personal appearance protects:

  • The signer from fraud

  • You from liability

  • The integrity of the document


Without this step, nothing else matters.


šŸ‘‰ If the signer is not present, you do not proceed. Period.


(Florida does allow Remote Online Notarization when properly commissioned, but traditional notarizations still require in-person appearance.)


2ļøāƒ£ Carefully Identify the Signer


Now that the signer is physically present, your next step is confirming identity.


Florida allows three methods:

  • Valid government-issued ID (most common: driver’s license or passport)

  • Personal knowledge of the signer

  • Credible identifying witness(es) when allowed


🚨 Important: The ID must be current and valid. Expired identification is not acceptable for notarization.


Also take a moment to observe the signer:

  • Do they appear aware of what’s happening?

  • Are they signing willingly?

  • Are they under pressure or confusion?


Florida notaries are expected to refuse a notarization if the signer appears unable to understand what they are doing or is being coerced.

Once you’ve confirmed the signer is valid and present, then you review the document.


You’re not ā€œreadingā€ it — you’re scanning for key elements:


  • Whether the name matches the signer’s ID - if not, you stop here.

  • Whether a notarial certificate is included - if not, one needs to be attached.

  • What type of notarization is required (acknowledgment, jurat, etc.)

  • Any blank spaces. They would need to be filled out by the signer - not the notary


🚨 Never give legal advice or explain what the document ā€œmeans.ā€

Your role is strictly notarial — not interpretive. If client has any questions he should call the party/entity that issued the document to receive clarification.


4ļøāƒ£ Complete the Notarial Certificate


If the document does not include a certificate, you may attach a loose certificate appropriate for the act.


Key points:

  • You might briefly explain the difference between an acknowledgement and a Jurat, but you do NOT choose the notarization type for the signer.

  • The signer (or issuing agency) must determine the act

  • Ensure the certificate is fully completed before signing


Florida Venue Reminder:

ā€œState of Florida, County of ____ā€ must reflect where YOU are physically performing the notarization.


Final step:

  • Sign exactly as commissioned

  • Affix your seal clearly (no overlap with text)

  • Ensure everything is legible and complete

Your journal is your protection.


Record the notarization immediately after completing the act, including:


  • Date and time

  • Type of notarization

  • Signer name

  • ID used

  • Document description

  • Signature of signer

This creates a legal record that protects you if anything is ever questioned.

If notarization could not be completed due to any reason, it is always a good idea to write that on your journal too.
